These Terms and Conditions ("Terms") are an agreement between you and the operator of Clawout ("Clawout", "we", "us"). You can reach us at clawoutsolana@proton.me.
They apply to the Clawout website, the browser game and demo, the game servers, and everything connected to them (together, the "Service"). By using the Service, connecting a wallet, or holding an in-game balance, you accept these Terms. If you don't accept them, don't use the Service.
Please read sections 5 to 9 and 15 to 18 carefully. They explain the risks of $CLAW and in-game balances, and they limit our liability.
1.1 You must be at least 18 years old, or the age of legal majority where you live if that is higher.
1.2 You may not use any part of the Service that involves $CLAW, buy-ins, payouts, loot boxes or staking ("Paid Features") if you are located in, resident in, or a citizen of a country or region where such activity is prohibited or requires a licence we don't hold. Before any Paid Feature becomes available, we will publish in the game the countries where it can be used; it may not be used anywhere else. This always excludes any country or region subject to sanctions by the United Nations, the European Union, the United Kingdom or the United States.
1.3 You may not use the Service if you are on a sanctions list, or if using it would break any law that applies to you.
1.4 You are responsible for checking that using the Service is legal where you are. By using Paid Features, you confirm that it is.
1.5 We may block access from certain locations, ask you to confirm your age or location, and refuse or end access if we believe these conditions aren't met. Using a VPN or other tools to get around these restrictions is a breach of these Terms.
2.1 Clawout is a video game. Parts of it are in early development, including the free demo, the beta and online modes. Features may be incomplete, change, contain bugs, or be removed.
2.2 We may change, pause or stop any part of the Service at any time, including worlds, modes, pandas, items, prices, odds, rewards and the economy, for example to fix balance, bugs, exploits or legal issues.
2.3 We don't promise that the Service will always be available, fast, error-free or secure. Servers can go down, and maintenance can interrupt raids.
2.4 Bots. Raids and matches may include computer-controlled pandas ("bots") to fill empty places. In the demo, all rivals are bots. In online raids, real players replace bots when they join. Bots never receive payouts; loot they carry out is returned to the rewards pool.
2.5 The demo. Balances in the free demo on our website are play money. They have no value and can't be exchanged for $CLAW or anything else.
2.6 Launch mode. At launch, the game is free to play: there are no buy-ins, no $CLAW payouts from raids, no loot boxes and no staking. Sections 6, 7 and 9 apply only once, and only where, we make those features available. We'll announce it on our official channels before switching any of them on.
3.1 You sign in by signing a message with a Solana wallet you control. That wallet address is your account. One account per person; you may not use multiple accounts to gain an advantage.
3.2 You are fully responsible for your wallet, its private keys and seed phrase, and every action taken with it. We will never ask for your seed phrase or private key and we never DM first. Anyone who does is not us.
3.3 If you lose access to your wallet, we can't recover it or your account.
3.4 Blockchain transactions are final. We can't reverse a transaction sent to the wrong address, on the wrong network, or with the wrong token.
4.1 $CLAW is a token on the Solana blockchain, launched on pump.fun. It is meant to be used inside Clawout, for buy-ins, loot boxes, repairs and similar in-game purposes.
4.2 $CLAW is not an investment. It gives you no ownership, equity, profit share, dividend, interest, voting right or claim on Clawout, its operator or its revenue. Nothing on the Service is an offer to sell securities, investment advice, financial advice or a recommendation to buy, hold or sell $CLAW.
4.3 No promise of value. We don't promise that $CLAW will have or keep any value, liquidity or price. Its price is set by the market on third-party platforms we don't control, and it can go to zero. Burns reduce supply; they are not a promise about price.
4.4 The launch, trading and liquidity of $CLAW happen on third-party platforms (such as pump.fun and PumpSwap) under their own terms. We aren't responsible for those platforms.
4.5 Only the contract address published on our official channels (our website and x.com/Clawout_sol) is $CLAW. We aren't responsible for fake tokens, fake websites or impersonators.
5.1 How balances work. To make fast in-game play possible, $CLAW used in the game is held in a wallet we control (the "Vault"), and your in-game balance is recorded in our ledger. Your in-game balance is a record of $CLAW you may withdraw, subject to these Terms.
5.2 Deposits. You deposit by sending $CLAW from the wallet you sign in with to the Vault address shown in the game. Deposits are credited after the transaction is finalized on-chain. Deposits from other wallets, other tokens, or other networks may be lost and can't be credited.
5.3 Withdrawals. You can request a withdrawal to the wallet you sign in with. Withdrawals may be subject to minimum amounts, daily limits, network fees, processing times and security checks. We may delay, limit or refuse a withdrawal where we reasonably suspect fraud, cheating, a security issue, a breach of these Terms, or a legal requirement, and we may ask you for information first.
5.4 Errors. If a balance is credited or paid by mistake, including through a bug, a server error or an exploit, we may correct it, reverse it, or deduct it from your balance.
5.5 Custody risk. Holding $CLAW in the Vault carries risks, including hacks, bugs, blockchain failures and the actions of third parties. We take reasonable security measures, but we can't guarantee the Vault can't be compromised. Only keep in the game what you're prepared to lose.
5.6 Dormant accounts. If an account has no activity for 24 months, we may contact you through our official channels and, after 90 days' notice, close it. Where the law requires, we'll handle remaining balances as the law says.
6.1 Buy-ins. Entering a paid raid costs a buy-in in $CLAW, shown before you join. Of each buy-in, 90% is placed in that raid's chests, 7% goes to the rewards pool and 3% goes to stakers. Buy-ins are not refundable once the raid starts, including if you disconnect, leave, get knocked out or run out of time.
6.2 Outcomes. What you take out of a raid depends on your play and on chance: where chests spawn, what they contain, and what other players and bots do. You may lose your whole buy-in. Past results don't predict future results.
6.3 Payouts. Loot you carry out on a balloon, and loot kept in your secure pocket, is paid to your in-game balance. The server's record of a raid is final, except where there was an error, cheating or an exploit.
6.4 Void raids. We may cancel a raid, void its results, or adjust payouts if it was affected by a server error, a bug, an exploit, cheating, collusion or a breach of these Terms. Where a raid is cancelled because of our error, we'll refund the buy-in.
6.5 Gear. Gear is never removed on a knockout, but it loses durability and may need repair. While the game is free to play, repairs are free; once paid features are on, repair fees are burned.
7.1 Loot boxes contain random virtual items. The odds for each rarity are shown on each box before you buy it.
7.2 You pay for a loot box when you open it. All loot box purchases are final and not refundable, except where the law requires otherwise. If you receive an item you already own, you may receive a partial refund as shown in the game.
7.3 Items from loot boxes have no cash value outside the game, except where the Service lets you trade them with other players.
7.4 Loot boxes may not be available in every country. Where local law restricts them, we may remove or change them for users there.
7.5 Loot box revenue is split as shown on the website: 25% to player rewards, 10% to tournament prizes, 20% burned, 45% to development.
7A.1 You can buy specific cosmetic skins with $CLAW in the skin shop. Prices are shown before you buy. Skins are cosmetic only and don't affect gameplay.
7A.2 All shop purchases are final and not refundable, except where the law requires otherwise. 20% of each purchase is burned.
8.1 Pandas, skins, gear and other in-game items ("Items") are licensed to you, not sold. You get a personal, non-exclusive, revocable right to use them in the Service.
8.2 We may change Items (for example their stats, looks or availability) to keep the game balanced and working. Changes don't entitle you to compensation.
8.3 Items can't be transferred, sold or exchanged outside the Service, unless the Service explicitly allows it.
9.1 You can lock $CLAW in staking for the periods offered. While locked, you can't withdraw it.
9.2 Staking rewards come from a share of raid buy-ins and are paid out by stake weight. Rewards are not interest, not guaranteed and not fixed. They depend on how much people play and can be zero. We may change reward shares, tiers, lock periods and perks.
9.3 Staked $CLAW carries the same custody risks as other in-game balances (section 5.5).
10.1 Quests, seasons, leaderboards, tournaments and giveaways have their own rules, shown in the game or where we announce them. Where those rules conflict with these Terms, the specific rules apply to that event.
10.2 Rewards are paid from the pools described on the website and only while those pools have funds. We may change, pause or end any event, and we may disqualify anyone who breaks its rules or these Terms.
10.3 You are responsible for any taxes on rewards you receive.

If you find a bug or exploit, report it to clawoutsolana@proton.me and don't use it. We may reward responsible reports.
12.1 If we reasonably believe you broke these Terms, we may warn you, suspend or close your account, block your wallet, remove Items, void results, and withhold or reverse rewards or winnings connected to the breach.
12.2 Where the law allows and no fraud or crime is involved, we'll return legitimately deposited $CLAW that isn't connected to the breach, minus amounts owed to us or other players.
12.3 We may report illegal activity to the authorities and share information with them where the law requires.
13.1 Play for fun. Only spend what you can afford to lose. Don't chase losses.
13.2 You can ask us at clawoutsolana@proton.me to limit or close your account for a period of your choice. If you feel your play is becoming a problem, contact a local support organisation.
You are responsible for any taxes, reporting and records connected to your use of $CLAW and the Service.
By using the Service and $CLAW, you accept, among others, these risks:
The Service is provided "as is" and "as available". To the maximum extent the law allows, we give no guarantees or warranties, express or implied, including about fitness for a purpose, availability, accuracy, security, or that $CLAW or Items will have any value.
17.1 To the maximum extent the law allows, we are not liable for any indirect or consequential loss, lost profits, lost opportunities, lost data, loss of value of $CLAW or Items, or losses caused by market movements, third-party platforms, your wallet, your own actions, or events outside our reasonable control.
17.2 To the maximum extent the law allows, our total liability to you for all claims connected to the Service is limited to the higher of (a) the total amount of $CLAW you paid us in fees (buy-in rake, loot boxes and repairs) in the 12 months before the claim, valued at the time of payment, or (b) โฌ100.
17.3 Nothing in these Terms limits liability that can't be limited by law, including liability for intent or gross negligence, or your mandatory rights as a consumer.
To the extent the law allows, you will compensate us for claims, losses and costs (including reasonable legal costs) caused by your breach of these Terms, your breach of the law, or your misuse of the Service.
The game, website, art, logos, code and text belong to us or our licensors. You may share screenshots and videos of the game for non-commercial purposes. Anything else requires our written permission. If you send us ideas, feedback or content (such as a name for an island), you allow us to use it freely, without payment.
We process personal data (such as your wallet address, gameplay data and, if you give it, your email) as described in our Privacy Policy on our website. If you connect an X account, for example for the launch quest, we store your X user ID and username and the link to the tweet you submit. We never receive your X password, we donโt keep access to your X account, and we never post for you.
We may update these Terms. We'll post the new version with a new date, and for important changes we'll give notice in the game or on our official channels at least 14 days in advance, unless a change is needed sooner for legal or security reasons. If you keep using the Service after a change takes effect, you accept the new Terms. If you don't agree, stop using the Service and withdraw your balance.
You can stop using the Service at any time and withdraw your balance under section 5. We may end or suspend your access under section 12, or if we shut down the Service. If we shut down Paid Features, we'll give reasonable notice where possible so you can withdraw.
23.1 These Terms are governed by the laws of the country where the operator of Clawout is established.
23.2 Disputes go to the competent court under those laws. If you are a consumer, you keep the protection of the mandatory laws of the country where you live, and you may also bring a claim in the courts there.
23.3 Before going to court, please contact us at clawoutsolana@proton.me so we can try to solve it.
24.1 If a part of these Terms is invalid, the rest stays in force, and the invalid part is replaced by a valid rule closest to its purpose.
24.2 If we don't enforce a right straight away, we don't give it up.
24.3 You may not transfer your rights under these Terms. We may transfer ours to a successor of the Service.
24.4 These Terms are written in English. If we provide a translation, the English version applies in case of conflict, unless the law says otherwise.
